If the children may be in irreparable harm an emergency is filed which is called a special guardianship. Upon proof the children are in irreparable harm, a show case hearing is held whereby the Court determines if the special stays in place until the general guardianship hearing is held. At the general guardianship hearing, the burden shifts where the guardian must prove the parents are unfit. In short, there are a great deal of legal hoops that one must go through, whether to obtain one, or fight one.
